Modi-led Indian Government Manipulating Judiciary to Strip IIOJK Rights

SRINAGAR: Experts and analysts based in Srinagar have expressed concerns that the Narendra Modi-led Indian government is utilizing the judiciary as a tool to unlawfully deprive the people of Illegally Occupied Jammu and Kashmir (IIOJK) of their rights.

According to the Kashmir Media Service, political experts and analysts, in various interviews and statements, highlighted the highly saffronized nature of the Indian judiciary since Modi assumed power in 2014.

Commenting on the pending decision by the Indian Supreme Court on Monday regarding petitions challenging the abrogation of Article 370 of the Indian Constitution, which granted special status to the occupied Jammu and Kashmir, they anticipated that the court, under the influence of the Rashtriya Swayamsevak Sangh (RSS) and Bharatiya Janata Party (BJP), would likely endorse the Modi regime’s illegal actions on August 5, 2019.

Indian Judiciary Biases in IIOJK Cases

The experts argued that such a decision would be a travesty of justice and a manifestation of a compliant Indian judiciary, emphasizing that the Modi government’s move to repeal Kashmir-specific Articles 370 and 35A aimed to strip Kashmiris of their rights, including identity, culture, and resources.

They called on the Kashmiri people to take to the streets in massive protests, asserting their voices for the rights allegedly seized by the Hindutva government in August 2019.

Critiquing the Indian judiciary, the experts noted a pattern of siding with the government in cases related to Muslims in India and IIOJK, giving priority to Hindutva ideology in verdicts.

The analysts reiterated that Modi’s revocation of the occupied Kashmir’s special status was a blatant violation of UN resolutions and urged the international community to exert pressure on India to restore Articles 370 and 35A of its Constitution specific to Kashmir.
