IIOJK High Court Orders Indian Authorities to Ensure Release of Detainees

ISLAMABAD: The High Court of Indian Illegally Occupied Jammu and Kashmir (IIOJK) has observed that the authorities should ensure the release of detainees without any wastage of time as and when their detention orders are quashed by the court.

These observations were passed by Justice Rahul Bharti in a contempt petition seeking implementation of the ruling passed by the court in December 2023 directing therein the authorities concerned to release the detainees forthwith from custody, according to Kashmir Media Service.

Justice Bharti said that this court has made known to the two officers the serious concern of this court about the loss of seventy-nine days of his life by the petitioner by remaining in detention without any legal basis.

The court further said that the detainee Shenwari came to lodge the present contempt petition apprising that despite quashing his preventive detention in terms of the verdict on December 30 last year has not earned his release from custody.

High Court’s Observation

It observed that the court hoped that such a scenario would not be repeated again and whenever the detention of a detainee gets quashed, the authorities would act with reasonable dispatch to ensure that the detainee is released from custody without unwarranted waste of time.
