Marketing Agency Sues Elon Musk’s X Over Infringes

WINDERMERE:  A legal marketing company has sued X formerly known as Twitter, in federal court in Florida saying the social media giant’s new name infringes its trademark letter X, Western media reported on Monday.

The X social media said that the decision of Elon Musk to rebrand to X from Twitter in July was likely to cause confusion among consumers.

It is the first case of trademark disputes with Musk’s company over the letter X.

The letter X is included in many federal trademarks owned by companies including Microsoft (MSFT.O) and Meta Platforms (META.O). Last month X Corp applied for its own U.S. trademarks covering the letter.

Florida-based X Social Media is an ad agency founded in 2015 by Jacob and Roseanna Malherbe to link Florida residents with attorneys in the wake of the Deepwater Horizon oil spill in the Gulf of Mexico.

The company in the lawsuit said it has used the “X Social Media” name since 2016 and owns a federal trademark over it.  It further said that it has invested more than $400 million in Facebook advertisements to reach clients.

The company claimed that Twitter’s rebranding is causing confusion among its customers. the lawsuit said X Corp has used its social media clout and marketing resources to dominate consumer perception about of its ‘X’ name.

X Social Media asked the court to direct Musk’s company to stop using the “X” name while requesting monetary damages.
